Employment Practices Liability Claims Examples – Commercial Truck Insurance

Employment Practices claims are on the rise. The following claim examples show how an employment case can damage your small business.

A female dispatcher at a Semi-truck company alleged sexual harassment against a coworker. The offensive conduct included remarks, touching and advances.

Result: $114,000 awarded, including $60,000 for punitive damages

A commercial truck driver claimed his employer suspended him without pay because of his obesity.

Result: Jury awarded $109,000

A female truck driver alleged that her male coworkers sexually harassed her with derogatory comments about women when she was present. After complaining to her supervisors, the harassment increased.

Result: $20,000 awarded in compensatory damages and $80,000 in punitive damages

After only working for a company for one week, a newly-hired employee was fired after reporting that a coworker used a racial slur against them.

Result: $200,000 total awarded: $25,000 in back pay, $75,000 for emotional distress and $100,000 in punitive damages.

As the first and only female truck driver at a concrete company, the plaintiff alleged that she was subjected to a hostile work environment, which included pornographic magazines around the building which referred to her by name, and that she was fired in retaliation for complaining about the harassment.

A Hispanic female tractor-trailer driver alleged gender and race discrimination, and retaliation. Due to a medical condition, she asked for exemption from an absence notification requirement mandated by a collective bargaining agreement. Her employer asked that she submit to a fitness-for-duty examination, which she refused.

Result: $644,750 awarded plus $511,000 in attorney fees and $34,000 in costs.

An employer claimed a truck driver suffered from mental disability that prevented him from being able to safely drive trucks and suspended him indefinitely. The truck driver claimed he was wrongfully terminated and a jury agreed.

Result: Jury awarded $757,701

A plaintiff, who was African American, was allegedly beaten on the job by coworkers for racial reasons. Throughout his employment, he was allegedly subjected to racial epithets and exposed to KKK literature in his locker and letterings on the facility’s bathroom wall.

Result: $800,000 awarded: $50,000 for past wage loss and $750,000 in punitive damages.
